Terms of Use

These Terms govern the Stop Circling website, Android app and related services we make available under these Terms (the "Service"). The Service is provided by Coastal Waterfall LLC ("we," "us," or "our"). Contact [email protected] with support, legal or security inquiries.

Stop Circling helps you discover and compare parking. Prices, availability and walking estimates can change or be incomplete. A search is not a reservation. Review the actual booking provider's final price, location, times and rules before purchasing.

1. Agreement and eligibility

By selecting Search parking after being shown a link to these Terms, or otherwise expressly agreeing to them, you accept these Terms. If you do not agree, do not use the search or other features requiring agreement. You must be at least 18, or the age of legal majority where you live if higher, and legally able to enter this agreement. If you use the Service for an organization, you represent that you can bind it, and "you" includes that organization.

Our Privacy Policy explains our information practices. Agreement to these Terms is not a substitute for separate consent where privacy law requires it. Feature-specific terms disclosed when you choose a feature may supplement these Terms; a conflict is resolved in favor of the feature-specific terms for that feature only, subject to mandatory law.

2. Parking discovery and third-party services

Public destination pages help you start a parking search with a venue already selected. A venue listing does not establish that parking search is supported there, that a particular parking option is available, or that the venue endorses or is affiliated with us. Venue names, general location information and category descriptions may change or contain errors. These pages do not provide an event schedule or confirm an event's date, entrance, operating hours or parking arrangements. Confirm your destination and visit times before searching; current coverage, prices and availability are checked as part of the search.

We currently provide discovery, comparison, estimates and links to third-party checkout. We do not currently operate the listed parking facilities, take parking payments, guarantee access, create reservations for you, or act as the booking provider. A booking contract, payment, parking license and cancellation/refund terms are between you and the relevant booking service or facility operator. Review those terms and direct booking-specific requests to that party. This does not exclude responsibility we have under applicable law for our own services or representations.

Inventory, prices, fees, taxes, operating hours, amenities, access restrictions, ratings and instructions come from third-party sources and may be delayed, incomplete, inconsistent or incorrect. Displayed prices relate to the selected interval and may be approximate; the provider's final checkout controls the purchase you choose. We do not guarantee the lowest price, complete market coverage, a particular result or continued availability. A displayed option, ranking, award, rating or link is not an endorsement, safety certification or guarantee.

Before buying or entering a facility, verify its address and entrance, dates, destination-local times, total price, vehicle/height limits, accessibility, re-entry rules and cancellation terms. Do not rely on a missing restriction as permission. Observe posted signs and lawful instructions. You are responsible for your vehicle, belongings and compliance with parking rules. We do not provide insurance, custody or security for your vehicle.

Maps, routes, travel times and walking distances are estimates. They can omit closures, stairs, private access, construction, weather or unsafe conditions and are not a guarantee of pedestrian access or accessibility. Use judgment and obey actual conditions. Do not interact with the Service while driving or when doing so would be unsafe.

The Service includes Google Maps features and content. Their use is subject to the Google Maps/Google Earth Additional Terms of Service and Google Privacy Policy. Maps also use Mapbox and OpenStreetMap data; applicable attribution remains with that content. External websites, SDKs and booking services have their own terms and policies. We do not control their availability or practices.

3. Permission to use the Service

Subject to these Terms, we grant you a limited, nonexclusive, nontransferable, revocable permission to use the Service for lawful personal use or your organization's internal parking needs. We and our licensors retain all rights in our software, design, branding and original content. Third-party content remains owned by its respective owners. No right to a trademark, database, API, source code or bulk inventory feed is granted unless separately agreed. Applicable open-source licenses and rights that cannot legally be restricted remain in force.

4. Prohibited use and security

You must not, and must not assist others to:

• Use the Service for fraud, impersonation, harassment, unlawful discrimination, infringement, money laundering, or other unlawful activity; submit information you know is materially false; or misrepresent your authority or affiliation.
• Access accounts, systems or data without authorization; steal credentials; distribute malware; inject code; interfere with other users; or attempt to evade access controls, rate limits, payment requirements, security measures or a suspension.
• Overload or disrupt the Service or our providers, generate abusive or deceptive traffic, enumerate private resources, make speculative or fraudulent reservations, or manipulate availability, reviews, rankings or referral attribution.
• Scrape, harvest, bulk-download, resell, republish or systematically extract our Service or licensed inventory, or use bots or automated requests, except through an interface and within limits we expressly authorize. Search and answer services may crawl our public informational pages to index them, provide attributed excerpts or summaries, and link visitors to those pages, subject to our published crawler directives and reasonable technical limits. This permission does not extend to automated parking searches, checkout actions, bulk live inventory extraction, restricted endpoints, or customer information. Ordinary browser accessibility tools and assistive technologies are permitted. This restriction does not remove statutory rights or permissions given by an applicable open-source license.
• Reverse engineer or bypass technological restrictions except to the extent applicable law expressly permits; remove attribution or rights notices; or copy our interface or content to impersonate the Service.
• Use the Service to identify, track or surveil another person without lawful authority, or to collect personal data unrelated to a permitted parking use.

Report suspected vulnerabilities privately to our contact above. Do not access others' information, disrupt service, retain unnecessary data, or exploit a finding. These Terms do not authorize intrusive testing or create a bounty program. We may grant written authorization for a defined research scope. Nothing here restricts lawful security reporting, protected whistleblowing, honest reviews, regulatory complaints, or other nonwaivable rights.

We may investigate suspected misuse, apply technical limits, restrict or suspend access, remove content, preserve relevant evidence, and cooperate with lawful requests when reasonably necessary to protect the Service, users or others. Where practicable and appropriate, we will provide notice and a way to contact us. We may act immediately for security, legal or urgent operational reasons.

5. Service development and future features

We may add, test, change or discontinue features, geographic coverage, inventory relationships, ranking methods and interfaces. We may introduce accounts, saved trips, notifications, subscriptions, loyalty benefits, merchant tools, integrations, booking or payment functionality, referral arrangements or clearly identified sponsored placements. Mentioning a feature does not mean it is offered now or create a promise to provide it.

New paid services, recurring charges, material sponsorships and additional customer obligations will be disclosed before you choose them, with any required agreement. We will not charge you for an optional service solely because you previously used a free search. Future collection or use of personal information remains subject to the Privacy Policy and applicable notice, choice and consent requirements. Changes will not retroactively alter an already completed third-party booking or remove rights already accrued.

We may use feedback you voluntarily provide to improve and develop our services without an obligation to compensate you. You retain ownership of your feedback, and grant us a nonexclusive, worldwide, royalty-free license to use it for those purposes. This permission does not authorize unrestricted use of personal information, confidential information or third-party material you cannot license. Please do not send unsolicited confidential ideas.

6. Availability and warranties

To the fullest extent permitted by applicable law, the Service is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose and noninfringement, and warranties arising from course of dealing or usage of trade. We do not warrant uninterrupted, timely, secure or error-free operation, or the accuracy, completeness or continued availability of third-party information.

We may interrupt access for maintenance, changes, legal requirements or events outside our reasonable control. Nothing in these Terms excludes an express commitment we make to you, a mandatory consumer guarantee, or liability that law does not permit us to disclaim.

7. Limits on liability

To the fullest extent permitted by applicable law, we and our officers, employees and agents will not be liable for indirect, incidental, special, consequential or punitive damages, or lost profits, business opportunities, goodwill or data, arising from the Service or these Terms, even if advised of their possibility. Subject to the exceptions below, our aggregate liability for claims arising from the Service or these Terms is limited to the greater of US$100 or the amount you paid directly to us for the Service in the twelve months before the event giving rise to the claim. Amounts paid to independent parking providers are not fees paid to us.

These exclusions and limits do not apply to fraud, fraudulent misrepresentation, willful misconduct, gross negligence, or any injury, violation of law, statutory remedy or other liability that cannot lawfully be excluded or limited. They apply only to the extent permitted in your jurisdiction and do not waive nonwaivable consumer rights. You remain entitled to remedies that mandatory law provides.

8. Responsibility for unlawful misuse

To the extent permitted by law, you agree to indemnify us for reasonable losses, third-party claims and reasonable legal costs to the extent caused by your fraudulent or unlawful misuse of the Service, intentional violation of these Terms, or infringement of another person's rights. This does not cover losses caused by our own misconduct or require a consumer to indemnify us where prohibited by law. We will give reasonably prompt notice of a claim, allow reasonable participation in its defense, and will not settle it in a way that imposes a nonmonetary obligation or admission on you without your consent, not unreasonably withheld.

9. Disputes and governing law

Contact us first if you have a concern so we can try to resolve it. This request does not delay a legal deadline or restrict access to a court, regulator, small-claims process or other remedy available by law. These Terms do not select an exclusive governing law or court; the law and jurisdiction determined under applicable legal rules will apply. Mandatory consumer protections and any right to bring proceedings in a forum provided by applicable law remain unaffected. These Terms do not impose mandatory arbitration or a class-action waiver.

10. Changes, termination and general provisions

The current published Terms are available at stopcircling.com/terms.html. Supported Android versions can retrieve revised documents without an app update and may display a labeled saved or packaged copy when an update is unavailable. Check its effective date. Merely opening, downloading or refreshing these Terms does not mean you accepted revised obligations; the notice and agreement requirements below still apply. Updating a legal document does not itself change the app's functionality.

We may update these Terms. We will post the revised version and effective date, and provide prominent notice of material changes before they apply, with renewed agreement where required. Changes apply prospectively and will not rewrite a dispute already arising under an earlier version. If you do not agree to new Terms, stop using the affected features. If a paid feature has different change or cancellation terms, those disclosed terms and mandatory law apply.

You may stop using the Service at any time. We may end or restrict access for a material breach, legal obligation, security risk, or discontinuation, subject to applicable law and any paid-service commitments. Provisions that by their nature should survive, including accrued payment obligations, intellectual property, lawful liability limitations, misuse responsibility and dispute provisions, survive termination.

These Terms and any applicable feature-specific terms form the agreement about the Service. If a provision is unenforceable, the remaining provisions remain effective to the extent lawful. Failure to enforce a provision is not a waiver. You may not assign this agreement without our consent, except as law permits. We may assign it in a business reorganization, merger or transfer of the Service, subject to applicable law, existing privacy commitments and your accrued rights. No agency, partnership, employment or joint venture is created. These Terms do not grant third-party enforcement rights except where expressly stated or required by law.
